It’s nearing two weeks since unions and their cohorts on the Left have thrown a nationwide fit over Scott Walker’s solution to what is ailing Wisconsin. Unions and Democrats have made Wisconsin their cause célèbre by deploying OFA astroturf, the big talking heads, as well as recruiting just about every known Grateful Dead concert attendee on their mailing lists into Wisconsin. Meanwhile, Democratic state senators (now humorously known as fleebaggers) comically continue to hold the state hostage over an issue of union power, politics and money—nothing more and nothing less.

Despite unions’ long hatred of Scott Walker, the new governor is moving to address both the symptoms of the disease and the disease itself—the public-sector union scheme that has molested Wisconsin’s taxpayers and their children by gaming the system. Unions like Wisconsin’s teachers’ union [WEAC] (which was Wisconsin’s biggest-spending lobby in 2009) have been extraordinarily adept at fixing the system through spending millions to elect politicians who, in turn, reward the unions at the expense of the taxpayers.

Now, in response to Walker’s proposals, the Left has gone overboard in their attempt to protect their stranglehold on Wisconsin taxpayers. Even though unions have made clear that their fight is not about their wages or benefits (they’ve offered concessions), they’ve made the fight all about their “right to be unionized” and the fictitious right to “collective bargaining”—which makes their cause even more despotic.

In making Madison into something reminiscent of the spectacle of the 1960s, unions, Democrats and their liberal cohorts are attempting to make the Wisconsin union battle into a civil rights battle, when it is not. In fact, the Wisconsin fight, when compared to private-sector negotiations is about: 1) the Scope of Bargaining, 2) Union “Income” Security [Right-to-Work vs. Forced Dues], 3) whether Wisconsin should be the unions’ dues collection agency [payroll deduction of dues], and 4) whether public-sector unions should be ‘recertified’ by holding elections every year.

Contrary to the Left’s hyperbole, Scott Walker’s proposals do nothing to eliminate public-sector workers’ right to association, assemblage, or to petition their government. Even pretending that it is a “rights” issue is a mistake. There is nothing in the U.S. Constitution that requires a government to engage in a back and forth negotiation with a collective of workers. In a poignant piece entitled There is No Right to Collective Bargaining, Public Service Research Foundation President David Denholm summarizes the problem with the unions’ argument, stating:

A law granting public-sector unions monopoly bargaining privileges gives a union, a special interest group, two bites at the apple. First, it uses its political clout to elect public officials. Then it negotiates with the very same officials.

When you consider that between 70 and 80 percent of all local government expenditures are personnel costs, you begin to get an idea of the magnitude of the power such laws give unions.

Not only is there no right to collective bargaining in public employment, it is wrong. Collective bargaining distorts and corrupts democratic government.

Collective bargaining is a process for employer-employee relations that was designed for the private sector. This process served as the model for the development of public-sector collective bargaining without taking into account the fundamental differences between the two sectors.

As Mississippi Governor Haley Barbour explains:

“When they have collective bargaining in Wisconsin, on one side of the table there’s state employee unions or the local employee unions. On the other side of the table are politicians that they paid for the election of those politicians,” Barbour said. “Now, who represents the taxpayers in that negotiation? Well, actually, nobody.”

Even Newsweek’s Evan Thomas noted on Sunday [via Newsbusters]:

The Democrats really depend on these public employee unions in a lot of states for their support and for their political muscle, and public employee unions got a problem here. I want to distinguish between unions and public employee unions. Unions obviously are critical, but in the public sector, public employee unions have a pretty easy time getting a lot of benefits because nobody’s really pushing back all that hard.

Admittedly, Walker’s proposals are a threat to unions in several ways. As Walker’s proposals determine:

The extent of what unions will be allowed to bargain about. Walker’s proposal limits bargaining to wages only, effectively eliminating the WEA Trust monopoly which gets its money from local school boards and runs it through a union-run insurance company.

Whether unions can have workers fired for not paying union dues. According to its most recent financial record on file, WEAC (the teachers’ union) raked in over $25 million in 2009. Walker’s proposal makes paying union dues voluntary, as opposed to mandatory. This goes to the lifeblood of any union. If, for example, 20% of those teachers who are currently required to pay union dues as a condition of employment opt out, WEAC could lose up to $5 million a year in revenue. [It is noteworthy that, in the private-sector, the SEIU will be conducting its second strike at a Pennsylvania medical center over the issue of mandatory dues.]

Whether the state will continue being the unions’ dues collector. Walker’s proposal eliminates’ the employers’ payroll deduction of union dues. Again, while it is commonplace for unions to negotiate payroll deduction, there is nothing anywhere (in private or public sector law) that states that it is an employers’ duty to be a union’s collection agency.

Whether the unions will have to ‘re-certify’ every year to maintain representational status. Of all of Walker’s proposals, this seems to be one that could be considered a ‘throw away’ item in negotiations. If Walker’s other proposals get enacted, and union-represented employees feel that the union is worthless, they can initiate an election themselves every calendar under existing law [see Section 111.83(5)[h]] .

Given the ability of the unions and their co-conspirators on the Left to hijack the issue in Wisconsin over these last two weeks, there appears no way for a “win-win” compromise to be worked out. One side or the other will win. Either the unions and the Left, or taxpayers will prevail.

If the Left wins, all chances of reforming public-sector unions will be tossed aside by weak-kneed Republicans who will then be held hostage by temper-tantrum throwing Democrats (see Indiana for example). In addition, the Left has already painted the entire Republicans party with bulls eyes and has for years. Therefore, there is no reason for GOP governors like Scott Walker, Chris Christie and John Kasich to back down, which puts the Left in an untenable situation as well.

In the meantime, the disciples of Saul Alinsky will continue their prattle, attempting to convince America that the Battle of Wisconsin is something more than a fight over union power, politics and money…even though it’s not.

I wrote about this right wing Georgia wild man Bobby Franklin a couple of months ago when he proposed that people shouldn't have to be licensed to drive. You may have heard about his recent attempt to criminalize miscarriages. Well Julie Ingersoll has connected the dots on this fine fellow and guess what? He's a Christian Reconstructionist:

Franklin has introduced a bill that lays out a "states' rights" argument that the US Supreme Court did not have jurisdiction to hear Roe v. Wade and that the Court has no constitutional authority to define who is a person and what constitutes murder.

The bill asserts in a preamble: "The State of Georgia has the duty to protect all innocent life from the moment of conception until natural death. We know that life begins at conception." The preamble is the justification for making what Franklin labels "pre-natal murder" illegal. (Georgia isn't the only state taking up new and controversial bills on abortion.)

What makes Franklin's bill different, though, is the provision on miscarriage. Miscarriage is not be considered pre-natal murder "so long as there is no human involvement whatsoever in the causation of such event." There is no indication as to how such a determination is to be made, and critics are charging that the bill would require women who have had miscarriages to provide evidence that they were not at fault, and possibly be subject to criminal investigations by the state.

Franklin's bio on the state legislature’s website claims he "has been called 'the conscience of the Republican Caucus' because he believes that civil government should return to its biblically and constitutionally defined role." That same website has a nifty little option that allows you to sort proposed bills according to their sponsors; so it was easy to get a sense of what he means by government's biblically-defined role.

He sponsored legislation to eliminate restrictions on bringing guns to church and to school. He proposed that the state of Georgia adopt a hard money currency system, and offered a resolution lecturing a state supreme court justice on the difference between a "democracy" and a "republic." He has proposed amending the law so that victims of rape would be referred to as "accusers" rather than "victims" (this applied only to rape and not other crimes, so one couldn't argue it was motivated by preserving the concept of innocent until proven guilty). Franklin has such a "limited view" of government that not only does he oppose public schools but he also thinks the state has no authority to issue driver's licenses.

Oh, but there's more on what Franklin thinks is government's "biblically-defined role." Franklin is a member of Chalcedon Presbyterian Church, one of the few out-and-out Christian Reconstructionist churches. Featured in Bill Moyers' 1992 documentary God in Politics: On Earth As It Is In Heaven, Chalcedon Presbyterian is pastored by Joseph Morecraft, a regular lecturer at American Vision and Vision Forum events. And all of the proposed legislation noted above has roots in Christian Reconstructionist teachings or the culture of Reconstructionist-oriented biblical patriarchy.

There are quite a few of these people in politics and the right wing is electing more and more of them as they take over the Republican party. It is not some fringe part of the movement anymore as Mother Jones reveals in this story about how these "justifiable homicide" bills are cropping up all over the country:
That these measures have emerged simultaneously in a handful of states is no coincidence. It's part of a campaign orchestrated by a Washington-based anti-abortion group, which has lobbied state lawmakers to introduce legislation that it calls the "Pregnant Woman's Protection Act" [PDF]. Over the past two years, the group, Americans United for Life, has succeeded in passing versions of this bill in Missouri and Oklahoma. But there's a big difference between those bills and the measures floated recently in South Dakota, Nebraska, and Iowa.

AUL's efforts to expand justifiable homicide statutes are part of a broader push by social conservatives to advance the political front lines on abortion and other social issues. After Republicans won the House of Representatives and swept to almost unprecedented state-level success in November, social conservatives were invigorated. Since state and federal legislative sessions began in January, they have pushed GOP lawmakers to introduce scores of bills aimed at promoting what they call a "culture of life."

That effort hasn't failed to stir up controversy. At the federal level, House Republicans have attempted to limit the circumstances under which the government would pay for abortions to cases of "forcible rape," a measure that was eventually dropped after it caused a national furor in January. Since then, cuts in federal funding for family planning, proposals specifically outlawing funding for Planned Parenthood, a Georgia bill that could criminalize some miscarriages, and the series of AUL-backed bills allowing for justifiable homicide in defense of a fetus have all helped put the culture wars back on the nation's front pages. With conservatives riding a wave of 2010 success and anti-Obama feeling into the 2012 elections, anti-abortion forces are just getting started.

There is an impulse among many liberal wonks and activists to flinch in the face of this sort of right wing assault and perversely shame those who try to raise awareness of it. I certainly heard my fill of it during the last election where my worries about a teabag revolution were met with eye rolling and derision from more than a few of my colleagues. My hope was that my fears would come to nothing, but at this point I think the evidence shows that the Big Money Boyz have decided to keep their rubes (who were always just as socially conservative as "fiscally" conservative) happy while they implement their Disaster Capitalist program.

Unfortunately, there will probably be a temptation for some Democrats to think that they will settle for these "less important" culture war items in exchange for letting up on the economic side and offer them up in negotiations. (Or that there are only so many fronts on which Democrats can fight so, let's let these go.) But everyone should know by now that when you give right wingers an inch, they take a mile. They want it all. And if push really comes to shove history shows that the Republicans will stab the social conservatives in the back long before they'll sell out the plutocrats, so there's really no point.

When I see someone like Richard Mellon Scaife criticizing the Republicans for going after Planned Parenthood, I realize that we are the proverbial frogs in slowly boiling water. The right has become very, very extreme and they are backed by big money and own one of the two major political parties in this country. And yet I haven't yet seen much visceral reaction from the policy elites aside from the usual pooh-poohing of the hysterical hippies Cassandra crones like myself.

Maybe Wisconsin and other grassroots reactions around the country will wake them up. I hope so. And I certainly hope that when they do, they realize that there is no "common ground" with people who want to criminalize miscarriage. They have declared all-out war.

They want it all. And if push really comes to shove history shows that the Republicans will stab the social conservatives in the back long before they'll sell out the plutocrats, so there's really no point.

When I see someone like Richard Mellon Scaife criticizing the Republicans for going after Planned Parenthood, I realize that we are the proverbial frogs in slowly boiling water. The right has become very, very extreme and they are backed by big money and own one of the two major political parties in this country. And yet I haven't yet seen much visceral reaction from the policy elites aside from the usual pooh-poohing of the hysterical hippies Cassandra crones like myself.

Maybe Wisconsin and other grassroots reactions around the country will wake them up. I hope so. And I certainly hope that when they do, they realize that there is no "common ground" with people who want to criminalize miscarriage. They have declared all-out war.

However, almost immediately after the deal went through, I started seeing some rumblings on Twitter, picking at the scab that has always annoyed a certain group of people about The Huffington Post: that it doesn't pay most of its writers. Sure enough, it didn't take long for this issue to start to spread, with the inevitable summary line of: "Hey, HuffPo became famous because all these people worked for free, and yet, they don't get a cut of the sale."

That story is now snowballing. Dan Gilmor wrote a blog post arguing that it was the "ethical" thing to do to start paying bloggers. Douglas Ruskoff said that he'd no longer blog on the site for free. And, of course, a bunch of cranky HuffPo contributors have created a whole campaign arguing that Arianna Huffington had no right to sell the site, since it was built off of their free labor.

They're all wrong.

Of course, we've been through this before. Five years ago, Nick Carr tried to argue that all the various big Web 2.0 sites like (at the time) Digg, YouTube and MySpace were really digital sharecroppers exploiting labor. As we argued at the time, this was hogwash. People were using those sites because they provided a valuable service. The reason they provided labor was because they got something of value in return -- whether it was attention or hosting or distribution or reputation.

Three years ago, we saw an almost identical controversy after AOL bought Bebo and musician Billy Bragg demanded some of the $850 million AOL paid (in retrospect, a massively bad decision). Bragg argued that Bebo made this money based on all of the "free labor" of musicians who used the site. But that ignored the fact that those musicians got tremendous value in using the Bebo platform to connect with fans and distribute their music... all for free. The folks who got to keep the money were the ones who took the actual risk. The ones who had to cover the expenses to keep the site and the service running, even when it wasn't making enough revenue. They took the risk, they should get the reward. The people who used the site did so of their own free will knowing quite well that the benefit they got from using the service was worth it to them at the time. Along those lines, if Bebo had struggled and faced bankruptcy instead of a massive buyout, would Bragg have felt obligated to give them money to keep it going? Similarly, if HuffPo had been running out of money, and Arianna had gone back and demanded that those who used the platform pay up retroactively, how would these people have reacted?

There are more ways to "get paid" than with money.

The reason that people chose to blog for free at the Huffington Post was because it's a fantastic platform for exposure. It brings traffic like no one else out there, and if you want to present something in a way that's likely to get more attention than on your own blog that no one visits, posting at HuffPo can be quite a good way to go.

And that's the point: the people who chose -- of their own free will -- to post at the Huffington Post for free did so because they clearly got value out of doing so. Otherwise, why would they have done so in the first place? To then say that the only proper thing is to pay them is completely missing the point. It's an attempt to retroactively go back and change the terms of a deal. If you wanted to get paid directly for what you write, fine, don't write for the Huffington Post. It's that simple. Go out and pitch your stories to publishers who pay freelancers. But don't go back and complain afterwards when the folks who actually did take the risk of putting together the site, financing it, organizing it, hiring the staff, buying the servers, paying for the bandwidth, and building it up so that it was such a successful platform, then get paid for their efforts.

And hopefully not alienate them in the process. Today, Mark Zuckerberg inched closer to that dream of a trillion dollars by offering streaming movies — and tanking Netflix's stock. Meanwhile, YouTube closed a deal on a production company presumably to make its very own content. Intel cast a wide net to examine tech companies' latest money-making ventures. Moneymaker: Warner Bros. just became the first Hollywood studio to stream movies directly on the social network. Foursquare

Moneymaker: At SXSW this week, Foursquare is set to announce a partnership with American Express that will link users' credit cards with their Foursquare accounts. The incentive to consumers? Deals like "spend $5, save $5" at participating merchants. Although Foursquare said its motivation is to increase membership and loyalty and that it won't charge Amex for the privilege, it's hard to believe that will stay the case if it catches on.

Downside: We don't have an Amex card. And (confession) although we use the app for recommendations, we've never actually checked in anywhere. Sorry, Dennis and Naveen! But if they add other credit cards, we would.

What's next: How about a service that warns you beforehand if you're about to friend one of those compulsive people who check in with handfuls of people at name-dropping locales?

YouTube

Moneymaker: YouTube just closed a deal to buy Internet video company Next New Networks, the producers behind Auto-Tune the News, for less than $50 million. Although rumor had it that Google was trying to get into the video-production business, Business Insider reports that the move is actually designed to help existing YouTube partners make "more and better content." Which then leads to more users and, subsequently, more expensive ads.

Downside: Isn't YouTube's strength either grainy weird viral videos or pirated television, movie, and music content? The second could definitely use better quality, but does it even matter for the former?

What's next: How about veering into Hulu territory?

Moneymaker: Just regular old advertising on the Windows version of its paid video communications service.

Downside: Although Skype says it won't show ads during the video conferencing yet, this could devolve into a Minority Report-style advertising assault.

What's next: Would it be possible to embed microphone/receiver in our brain so we don't have to use the special headset? Just curious.

Update: TechCrunch makes an important clarification. Facebook hasn't announced its own streaming movie service. Rather the movie offering comes from Warner Brothers app that uses Facebook Credits' payment system. But if it proves successful and other studios follow suit, Zuckberg can still count on more personal credit card info coming his way. Someone better go tell Netflix's shareholders.

We have been averaging about 2 US associate or counsel placements per week in Asia so far this year, a blistering pace that can’t continue quite frankly, but is an indicator of how hot the market is right now (see recent Asia Chronicles ATL posts for more details on this hiring boom or do a search at theasiachronicles.com for such info).

Just the fact that Robert and I can set up meetings on short notice with the leading corporate partners of top US and UK firms in HK / China (especially in a boom market where time is at a premium for such persons running multiple big deals on understaffed teams) is a major difference between Kinney and other recruiting firms trying to break into the increasingly hot US associate biglaw lateral hiring market in HK / China. Remember that just about every US and UK firm in HK / China are hiring US corporate associates at this time, so you should not settle for a recruiter / agent who simply is aware of openings and can provide a list of firms and can name a few partners there.id="more-61267">

Our best recruiters work with associates and partner candidates, not just partners. Robert Kinney and I have had success in placing partners and groups in HK / China, but we still work directly with associate candidates, along with our other Asia team recruiters, Alexis Lamb, Yuliya Vinokurova, Danielle Cyr and Peter Guttensohn. I mention this because at most recruiting firms, the best recruiters focus on partners and pass on associate candidates to less experienced and less successful recruiters. We have also placed numerous US associates a second time in Asia, whether in-house or another law firm after a few years at their first firm in Asia.

Keep in mind that even if you are ready to start an Asia job search right away, even in this hot lateral market it can be a long process for some very qualified candidates. You can’t afford to entrust your job search and representation at various firms to a recruiter who simply emails your resume and hopes for the best. Robert and I, along with our other Asia recruiters, are personally involved in advocating for our candidates over the long-term, if need be. We are close with the relevant partners and can bring up your candidacy in person or by phone whenever it is appropriate to do so. It is not simply a case of emailing a resume and hoping for the best, with only being able to provide administrative services of coordinating interviews. It is quite shocking but that is all you are going to get from the vast majority of recruiters out there, despite what their 10 to 20 minute sales pitch may be upon meeting you.

Don’t lose sight of the fact that once you are submitted to a firm by a recruiter that recruiter unfortunately “owns” your candidacy at such firm for 6 months or more, causing most recruiters to focus on simply being able to make the submission, rather than provide a service.

Our Asia recruiters are on the ground in Asia and US, and all of our Asia team spends time in our New York and Hong Kong offices. It is not uncommon for a NYC based associate to call Kinney to start a job search and within a week both meet a Kinney Asia recruiter in NYC and for that same Kinney recruiter to be advocating for them on the ground in Asia, meeting in person with relevant partners in Asia on their behalf. No other recruiting firm can offer this because quite simply, we travel more than others do and happen to have offices in both US and Asia. We make it a point, for example, to have at least one recruiter on the ground in Hong Kong, 365 days a year.
